  • Unless we say otherwise in this Privacy Policy, we do not use personal information to market or advertise to you beyond what is described below.
  • We do not sell User personal information for money. As described in Section 4 and Section 10 below, certain uses of cookies and advertising technologies on our Website may be considered a "share" of personal information under California law, and you have the right to opt out of that sharing.

Architectural Supplements does use your personal information for certain stated purposes, such as providing and improving our Website, processing and fulfilling your orders, and communicating with Users about new Architectural Supplements features, products, and events. Please read this Privacy Policy. It describes what information we collect from you and how we use that information.

This Privacy Policy applies to personal information Architectural Supplements LLC ("Architectural Supplements," "we," "our," or "us") collects online and offline, including:

  • by phone or email (for example, when you place or modify an order);
  • through our website at architecturalsupplements.com (the "Website"), which is hosted and operated using the Shopify ecommerce platform provided by Shopify Inc. ("Shopify"); and
  • through our enterprise systems (e.g., NetSuite) that synchronize with our Website.

"You" are a "User." This Privacy Policy forms a part of the Website Terms of Service and shares the same terminology. You should read both documents together.

1. California Notice at Collection of Personal Information (online and offline)

In the preceding twelve (12) months, Architectural Supplements has collected and processed the categories of personal information identified in the tables below for the business purposes indicated, retained such information for the periods described, and disclosed whether such information is shared for cross-context behavioral advertising unless you opt out, where applicable:

2. Information Architectural Supplements Collects

We collect the categories of personal information shown in the Notice at Collection table above in Section 1, including identifiers/contact details, account information, commercial information, limited internet activity information via cookies and similar technologies, and communications you send us (online and offline, such as when you contact us by phone or email).

Payment information (such as credit or debit card details) that you enter at checkout is collected and processed on our behalf by Shopify and its integrated third-party payment processors (for example, Shopify Payments and/or other card processors made available through our Shopify store). We do not store your full payment card number on our own servers.

2.1 Cookies and Similar Technologies

Architectural Supplements, through Shopify and other service providers, uses cookies (small text files placed on your device) and similar technologies to provide the Website, to help collect data, and to market to Users. These fall into a few categories:

  • Necessary/functional cookies: These allow the Website to operate, such as keeping items in your shopping cart, enabling secure checkout, remembering your login, and preventing fraud. Many of these are set directly by Shopify as part of operating our store.
  • Analytics cookies: We use tools such as Google Analytics to understand how Users browse and interact with the Website so we can improve it.
  • Advertising/retargeting cookies: We use advertising technologies such as the Meta (Facebook/Instagram) Pixel, and may use similar tools such as the TikTok Pixel or Google Ads tags, to measure the performance of our ads and to show you more relevant ads on our Website and elsewhere. These technologies may collect information about your visits to our Website and other websites over time.

The Website may also include web beacons and cookies from third-party Website providers, including:

  • Companies we hire to provide services on our behalf, such as site analytics or advertising measurement, which may place cookies when you visit our sites.
  • Companies that deliver content, such as videos linked or embedded, which place cookies on their own. These companies use the data they process in accordance with their own privacy policies, which may enable these companies to collect and combine information about your activities across websites, apps, or online services.

Each User has a variety of tools to control cookies, web beacons, and similar technologies, including browser controls to block and delete cookies, opt-out tools offered by Google and Meta for interest-based advertising, and industry opt-out pages maintained by the Digital Advertising Alliance (optout.aboutads.info) and Network Advertising Initiative (optout.networkadvertising.org). We also honor the Global Privacy Control (GPC) signal as an opt-out of sale/sharing where legally required. User browser settings and other choices may impact the functionality of the Website.

3. How We Use Your Personal Information

We use personal information to operate and improve the Website, create and manage accounts, process and fulfill orders, provide support and communications, measure advertising and site performance, ensure security and prevent fraud, and comply with legal obligations. See the Notice at Collection table in Section 1 for the purposes associated with each category of personal information. We store and process User personal information in the United States. Architectural Supplements does not use your personal information to market or advertise to you beyond what is described in this Privacy Policy.

3.1 Analytics, segmentation, and automated decision-making

We use analytics and marketing tools to segment audiences and measure campaign performance. We do not use automated decision-making that produces legal or similarly significant effects (for example, decisions about eligibility for credit or individualized pricing without human involvement). If that changes, we will update this Policy and provide any legally required notices or opt-out rights. We do not use sensitive personal information to infer characteristics.

4. Information We Share

Architectural Supplements does not sell User personal information for money. For whether each category is sold or shared for cross context behavioral advertising and your opt out rights, see the Notice at Collection table in Section 1 and the Your Privacy Choices link in our site footer.

We share personal information we collect on Users when Users create accounts, place orders, request support, or otherwise use the Website. We share personal information with vendors, consultants, and other third-party service providers who need access to such information to carry out work on our behalf and at our direction, including:

  • Shopify Inc., which hosts our Website, powers our online store, and processes orders and transactions on our behalf.
  • Payment processors integrated with our Shopify store (for example, Shopify Payments and/or other card processors) to process your payment when you place an order. We share only the information necessary to complete your transaction.
  • Shopify Email and HubSpot, which we use to manage our marketing communications, mailing lists, and to deliver newsletters and other marketing emails. When you create a User account or sign up for our marketing emails, your contact information is shared with and stored by these providers for this purpose. You may unsubscribe from marketing emails at any time by clicking the "unsubscribe" link at the bottom of our emails.
  • Analytics and advertising providers, such as Google Analytics and Meta (Facebook/Instagram), to measure Website and ad performance and, where permitted, to deliver interest-based advertising. Because these providers may use the shared information for their own advertising purposes, this sharing may be considered a "share" of personal information under California law even though we receive no money for it. See Section 10 below for your opt-out rights.
  • Data center operators and communications vendors that we rely on to operate our Website or send you notifications.

We may also share User personal information for legal, protection, and safety purposes. For example:

  • We may share information to comply with applicable laws.
  • We may share information to respond to lawful requests and legal processes.
  • We may share information in an emergency, such as protecting the safety of our employees and agents, our Users, or any person.
  • We may share information to protect the rights and property of Architectural Supplements, our agents, employees, customers, and others, including by enforcing our agreements, policies, and terms of use.
  • We may disclose or transfer your personal information in connection with the sale, merger, bankruptcy, sale of assets, or reorganization, in whole or in part, of our company.

In any such case, Architectural Supplements requires recipients to comply with the terms of this Privacy Policy and all applicable data privacy and security laws.

In the unlikely event we discover that a recipient is using personal information in a way that conflicts with this Privacy Policy, we will take all reasonable steps to stop them.

5. Information Choices and Changes

Users may opt out of providing personal information to the Website at any time by ceasing to use the Website and by emailing info@architecturalsupplements.com to have their account removed. Architectural Supplements will stop collecting the User's personal information in these cases, but may still retain the User's personal information as outlined in "Data Retention" (Section 8) of this Privacy Policy (below).

Our communications regarding events, news, and other such topics explain how to opt out of receiving such emails. If a User opts out, we may still send them operational emails that pertain to the User's account, orders, and notifications regarding our Website.

Users may send requests about their personal information to our contact information in Section 13 below, including to change contact choices, opt out of our sharing with others, and review, update, correct, or delete personal information. Once the User has been authenticated, we will use commercially reasonable efforts to honor these requests. We may retain an archived copy of User records as required by law. Such opt-outs may result in disruption or cancellation of the Website or impairment of certain Website functionality.

6. Children

This Website is intended for Users eighteen (18) or older. It is not in any way designed to attract children. If we discover that a person under the age of eighteen (18) has submitted personal information to our website, or that someone has inappropriately done so on their behalf, we will delete such information from our databases as soon as practicable and in accordance with applicable law.

7. Information Security

We use security technologies and procedures to help protect your personal information from loss, misuse, and unauthorized access, use, disclosure, alteration, and destruction. Our Website is hosted on the Shopify platform, which maintains PCI-DSS compliant payment processing infrastructure for handling checkout and payment card data. Our security procedures and practices are consistent with industry standards applicable to our collection and use of personal information. In the event of an unauthorized release, disclosure, or acquisition of User information, Architectural Supplements will notify affected individuals, as required by applicable law. While we use reasonable efforts to protect your personal information, no company can guarantee its absolute security.

8. Data Retention

We retain personal information as described in the Notice at Collection table in Section 1 and as necessary to comply with legal, accounting, or audit obligations, resolve disputes, and enforce our policies and agreements.

9. How to View, Correct, or Update Personal Information

Users can update their information by logging into their accounts and visiting the Account Settings tab on the User profile. If that is not effective, the User can contact us directly at info@architecturalsupplements.com.

10. Rights of California Residents

The California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), provides California consumers with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights. For categories of personal information collected, business purposes, whether information is sold or shared, and retention periods, see the Notice at Collection table in Section 1 at the top of this Policy. For information on our use of analytics, segmentation, and automated decision making, see Section 3.1 (Analytics, segmentation, and automated decision making). If our practices change in a way that triggers additional rights, we will update this Policy and provide any required notices or opt out rights.

10.1 Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Section 10.6, Exercising Your Rights), we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting, selling, or sharing that personal information.
  • The categories of third parties with whom we sell or share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold, shared, or disclosed your personal information for a business purpose, separate lists disclosing the categories of personal information involved.

10.2 Right to Opt Out of Sale or Sharing of Personal Information

We do not sell personal information for money. However, our use of advertising cookies and pixels described in Section 2.1 and Section 4 (such as Google Analytics and the Meta Pixel) may be considered a "sale" or "share" of personal information under California law. You have the right to opt out of this sharing at any time by:

  • Emailing info@architecturalsupplements.com with your request, or
  • Using your browser's Global Privacy Control (GPC) signal, which we honor as a valid opt-out request, or
  • Using our Your Privacy Choices link in our site footer, or
  • Using the cookie/ad-preference controls described in Section 2.1.

10.3 Right to Correct Inaccurate Personal Information

You have the right to request that we correct inaccurate personal information we maintain about you, subject to certain exceptions.

10.4 Right to Limit Use of Sensitive Personal Information

Payment card information is considered "sensitive personal information" under California law. We use this information only to process your transactions and for related security and fraud-prevention purposes, which are uses that do not require us to offer an additional opt-out. We do not use sensitive personal information to infer characteristics about you.

10.5 Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  1. Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
  2. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
  3. Debug products to identify and repair errors that impair existing intended functionality.
  4. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
  5. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
  6. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.
  7. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  8. Comply with a legal obligation.
  9. Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

10.6 Exercising Your Rights

To exercise the rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password-protected account sufficiently verified when the request relates to personal information associated with that specific account.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

10.7 Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response through that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

10.8 Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information's value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt-in consent, which you may revoke at any time.

11. Canadian Users

If you are located in Canada, we process your personal information in accordance with applicable Canadian privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA). You may contact us using the information in Section 13 below to ask questions about, access, or request correction of your personal information.

12. Changes to this Policy

We may make changes to this Privacy Policy from time to time. If we make changes to this Privacy Policy that we believe will materially affect your rights, we will notify you by email about these changes and post a notice to the Website and change the "Last Updated" date above. If you continue to use our Website after we provide such notice, you are agreeing to accept these changes. Otherwise, for non-material changes, the Privacy Policy will be updated on the Website. You should consult this Policy regularly for any changes.
